Ontario Vape Laws 2026: Age, Sales and Use

Ontario regulates who can purchase vaping products, how products can be displayed and promoted, and where people may smoke or vape. Federal rules for nicotine, packaging and excise duty apply at the same time.

Adults browsing a national vape catalogue should select Ontario before comparing availability. A listing shown for another province may use a different stamp, flavour assortment or tax treatment.

Ontario's Minimum Vaping Age Is 19

Under the Smoke-Free Ontario Act, 2017, a retailer cannot sell or supply a vapour product to a person under 19. Retailers must request identification when age is uncertain and should use accepted government-issued identification.

Age confirmation on a website is only one part of compliance. Online retailers and delivery partners can apply additional identity or age checks before handing over a restricted product.

Online Orders and Delivery

Ontario does not use Quebec's blanket in-person retail rule, so compliant online sales can occur. The retailer must still prevent supply to minors and provide the correct Ontario-stamped variant. Delivery instructions cannot override an age-verification requirement.

Final checkout totals can differ from a product-card price because Ontario participates in the coordinated vaping duty system. Compare the final Ontario total rather than selecting another province in search of a lower price.

Specialty Vape Store Rules

Ontario recognizes registered specialty vape stores that meet prescribed inventory and sales requirements. These stores can receive exemptions from some display and promotion restrictions, but they remain age-restricted and must follow the conditions of registration.

General retailers face tighter display and promotion limits. A product appearing behind the counter at one store may be presented differently at an adult-only specialty store without changing the underlying age or product requirements.

Where Vaping Is Prohibited in Ontario

Ontario prohibits smoking and vaping in enclosed workplaces, enclosed public places and many specifically listed outdoor areas. Examples include school and childcare grounds, children's playgrounds, publicly owned sporting areas and restaurant or bar patios, subject to the statutory definitions and exemptions.

Restrictions also apply around certain entrances and exits. Municipal bylaws, transit systems, landlords, employers and event venues can impose broader smoke-free rules. Follow posted signs even when an area is outdoors.

Federal Product Rules in Ontario

20mg/mL Nicotine Maximum

Vaping liquid manufactured or imported for sale in Canada cannot exceed 20mg/mL nicotine (SOR/2021-123). This applies to products in Ontario's vape juice collection and to prefilled disposables or pods.

Labelling and Health Warnings

Nicotine-containing products require prescribed federal labelling under the Vaping Products Labelling and Packaging Regulations. Consumers should keep the original package so concentration, warnings and the provincial variant remain identifiable.

Ontario Excise Stamp

Ontario has required its own province-specific vaping excise stamp since July 1, 2024 (CBSA Memorandum D18-3-2). Duty-paid vaping products intended for Ontario require the Ontario-specific stamp under the coordinated duty framework. A federal-only or other province's stamp is not the correct retail inventory for Ontario.
