Canadian vape laws combine federal product rules with provincial and territorial rules for age, retail sales, flavours and where vaping is permitted. A product can meet federal packaging requirements and still be restricted in a particular province.

Legal Age to Buy Vaping Products in 2026

Federal law prohibits selling or providing vaping products to anyone under 18, and provinces can set a higher age. Saskatchewan increased its age from 18 to 19 on February 1, 2024 under The Tobacco and Vapour Products Control Act. Quebec remains 18 for electronic cigarettes; its age 21 rule applies to non-medical cannabis, not nicotine vaping products.

Federal Rules That Apply Across Canada

Nicotine Cannot Exceed 20mg/mL

Vaping products manufactured or imported for sale in Canada cannot exceed 20mg/mL nicotine under the Nicotine Concentration in Vaping Products Regulations (SOR/2021-123), measured by the ISO 20714 method. Packaging must also meet federal labelling requirements, including nicotine concentration and the prescribed health warning when nicotine is present.

Duty-Paid Products Need an Excise Stamp

Disposables, prefilled pods and bottled e-liquid sold in Canada's legal market generally require a vaping excise stamp. Some provinces use a province-specific stamp because they participate in the coordinated duty system. The CRA EDN82 — Calculation of vaping duty explains the federal and additional provincial rates.

Promotion Is Restricted

Federal rules limit advertising that can appeal to young people, lifestyle advertising and certain flavour representations. Retailers must not treat a health warning or age gate as optional marketing copy.

Public Vaping Rules Vary by Province

Provinces and territories regulate vaping in workplaces and public places that are not federally regulated. The broad pattern is that vaping is prohibited wherever smoking is prohibited, including enclosed workplaces, restaurants, bars, schools and many public vehicles.

Outdoor buffer zones differ. Saskatchewan, for example, prohibits smoking and vaping within three metres of a doorway, window or air intake of an enclosed public place. Alberta also lists school and childcare properties, playgrounds, sports fields, outdoor pools and similar youth-oriented spaces. Municipal bylaws can extend these distances or cover additional parks and beaches.

Important Provincial Differences

Quebec: Flavours and Point of Sale

Quebec restricts flavours other than tobacco and sets specific requirements for how retail sales take place. Its minimum age is 18. Under section 14.1 of the Tobacco Control Act, tobacco products and electronic cigarettes may only be sold with the purchaser physically present in a retail outlet, and since October 31, 2023 only tobacco-flavoured or flavourless vaping products may be sold. Availability in Quebec therefore differs from a national disposable vape collection; check the options shown for your province at checkout.

Prince Edward Island: Age 21

PEI has Canada's highest provincial minimum age for tobacco and electronic smoking devices at 21. An adult who is 19 or 20 can legally purchase in many other provinces but cannot purchase a vaping product in PEI. Under the Tobacco and Electronic Smoking Device Sales and Access Act, an electronic smoking device may not be sold anywhere except a tobacconist shop (section 4.2), and it is an offence to sell tobacco or an electronic smoking device that contains a flavouring agent prescribed by regulation (section 3.1). Even in a tobacconist shop, a device whose packaging shows a nicotine concentration above the prescribed limit may not be sold. Check the current prescribed list before assuming a specific flavour is available in PEI.

Nova Scotia: Provincial Excise Stamp in 2026

Nova Scotia joined the coordinated vaping duty system on April 1, 2026 (SOR/2026-41). A transition period ran to June 30, 2026, so since July 1, 2026 products sold in Nova Scotia's duty-paid market require a Nova Scotia-specific vaping excise stamp. This is separate from the province's public-use and retail rules.

Saskatchewan: Age 19 and Retail Flavour Controls

Saskatchewan's minimum age is now 19 (provincial legislation). Most flavoured vapour products are restricted to adult-only specialty vape shops, while retailers open to minors face tighter product and display limits.

Online Ordering and Province Selection

Online stores may request date-of-birth confirmation, government identification or age verification at delivery. Choosing a province variant is also necessary for tax stamps and product availability. A failed checkout can mean the selected item is not configured for that destination, not that the listed product page is broken.
